Military veterans who need assistance with their day-to-day activities often face a losing battle when it comes to paying for that care. One relatively unknown benefit available to qualifying veterans is the โ€œAid and Attendanceโ€ program.

Aid and Attendance

This program pays a monthly benefit to veterans and their families who need assistance with their daily activities or who are housebound.ย  ย 

Qualifying for this Benefit.

Veterans may receive Aid and Attendance payments if they meet one of the following conditions:

  • Needs assistance with two activities of daily living including:ย ย bathing, feeding, toileting, transferring and dressing.
  • Is completely bedridden due to a disability.
  • Receives nursing home care due to a physical or mental incapacity.
  • Has severely limited eyesight.

Eligibility is based on:ย 

  • The veteranโ€™s service.ย ย The veteran must have served at least 90 days of activity military duty.ย ย At least one day must have been during wartime. The veteran must not have received a dishonorable discharge.
  • Medical condition.ย ย The veteran or spouse must prove they need another person to help with their activities of daily living, as defined by the Veterans Administration.
  • Financial need.ย The veteran or surviving spouse must prove financial need, both in assets and income. However, asset and income limits have not be specified by the VA. The VA reviewer will review your financial data and make a determination.

The Application Process.

As is true with other government programs, applying can be a complicated, lengthy process. While forms are available, we advise veterans to consult with us before applying. Applicants who are denied must wait a year before reapplying. Our office assists veterans with their applications at no charge.*

Appealing a Denial

Applicants who are denied benefits may file an appeal. If you did not use an attorney for the application process, itโ€™s critical that you consult with one now. At Miller Estate and Elder Law, we handle this type of case on a contingent basis. You donโ€™t pay anything upfront. Our fees will be paid if you receive a settlement.
